Gas stations do not give full liter when shipped to consumers. At least one in three concessionaires Pemex less gasoline delivered to their customers, and there were some – were the least-although that endangered the lives of people to have leaks at their facilities.
This is the result of the analysis made by the Unit Data Journalism and Spaceshipslab organization, from the data yielded verifications by the Federal Consumer (PROFECO).
Grantees of these outlets have shown they do not like to comply with the Official Mexican Standard (NOM) 005, which checks with electronic evidence, manuals, and software, are the state of the vending pumps. This because they are opposed to the revision in some gas stations or even go to file injunctions.
This was detected by the PROFECO, which verified over a period of five to seven thousand 987 gas stations, and of these, 29% (two thousand 340) gave incomplete consumers liters, so were penalized or fined.
The information was obtained through the application of information 1031500031411 sheet, which contains the database “Who’s Who in gasoline?” Section and Targeted Transparency Profeco ( http://www.profeco .gob.mx / transparency / transfocaliza / transfocaliza.asp ) containing the database “Open Semaphore”.
Leaks and alterations
One in two verified stations (ie over 49%) already had complaints against them by consumers, not receiving full liter or make some other irregularity, such as leaks in your facility (568 stations), gasoline adulterated (41), electrical abnormalities (705), or to anomalies in the price (75).
The PROFECO has reduced nearly 300 testers for more than 10 thousand gas stations that exist throughout Mexico group;also encountered resistance dependence of at least 401 thousand vending stations to not be verified, and even 116 owners took refuge to not revise.
This occurred during the period 2005-2011, years comprising the database of “Who’s who at the pump?” And includes the most comprehensive information PROFECO composed as a result of these reviews.
Adulterated fuel
Selling incomplete “liters” is not the only irregularity that occurred during this period gas stations, for 41 dealerships selling adulterated fuel.
For all abnormalities, PROFECO imposed fines amounting to nearly 32 million, according to its institutional report containing information until 2010, entitled “Procedures for Violations of Law (PIL).”
The information reflects all these irregularities was obtained, organized, and mapped by Spaceshipslab (http://spaceshiplabs.com/ ), and creative software lie in Cancún, Quintana Roo.
Barron and Daniel Yáñez Salvador have created several sites that promote the use of open data and the use of programs and applications that help you organize and display information in a comprehensible manner.
Attorney ‘toothless’
PROFECO has no way of knowing that the penalties for this dependence became effective, it is not directly responsible for executing them. Furthermore, it only has 295 verifiers to review more than 10,000 gas stations in the country.
Therefore, Lorena Martinez, head of the Attorney, lobbying reform to the Federal Consumer Protection Act for the institution has “teeth” and can impose fines directly and not get lost in the bureaucratic maze.
The official recently reported that as of this month would have over 300 verifiers in addition to the 295 already had the authority to deal with the constant complaints that consumers and increase inspection capacity.
Consumer organizations such as AC, who directs Daniel Gershenson, have denounced the lack of oversight by this institution, also have limited staff and budget to meet their work and limit abuses of the pump.
Another problem that afflicts PROFECO opacity is logging concessionaires. Currently there is no public file and systematized 2014. Recent data are located in Targeted Transparency, but they are few and 2013.
Dance figures
On 10 June, the Supervisory Commission of the Superior Audit of the Federation (ASF) requested a report from the Pemex gas stations to which revoked his grant by dispatching incomplete liters and procedures initiated from 2010 to 2014.
The lack of information was also evident through the Federal Institute for Access to Information and Data Protection (IFAI), as the guarantor agency determined that PROFECO should make known the last report generated to publish the so-called traffic light the Gas.
Currently the Official Mexican Norm (NOM) NOM 185 and 005 are the provisions that seek to prevent consumer fraud by the pump.
Although the final details of the checks carried out at gas stations remain a mystery to the Chamber of Deputies, the IFAI and citizens.
Bases (and broader) existing data are presented by EL UNIVERSAL, although Profeco related Semaphore the Pump were also used. The latest records date from 2012, and although there are requests for information from 2013, the data are not as extensive as those of previous years.
Due to the energy reform from 2018 is expected to be several gas stations operated by private or foreign oil. Meanwhile, transparent information should PROFECO to publicize the irregularities and so citizens can choose which station they go without their money stolen liter.
For this report was requested the opinion of the Attorney General, but no response was obtained. (Lilia Saul / Saul Hernandez / El Universal)
